The Canadian Department of Finance has announced the release of a package of draft legislative proposals for changes to the Income Tax Act and the Income Tax Regulations to accommodate Pooled Registered Pension Plans (PRPPs). These rules will set the stage for all provinces to introduce legislation to implement PRPPs. The PRPP tax rules have been designed to be simple and straightforward and to promote low-cost plans. They will encourage take-up by employers and ultimately, greater pension coverage among Canadians. The proposed tax rules for PRPPs will apply to both federally and provincially regulated PRPPs and will operate alongside the Pooled Registered Pension Plans Act. A backgrounder outlines the key measures proposed in the package, while explanatory notes provide further details. Interested parties may submit comments on the package until February 14, 2012.

Department of Finance Canada Invites Comments on Tax Rules for Employee Profit Sharing Plans August 31, 2011 The Department of Finance Canada is seeking comments on the tax rules for employee profit sharing plans (EPSP). The Government is reviewing the existing rules for EPSP to determine whether technical improvements are needed to ensure that EPSPs continue to be a useful vehicle for employers and that they are used for their intended purpose. The consultation document identifies several issues associated with current EPSP rules, followed by suggestions as to how the Government might address each issue.
- The Canada Department of Finance has announced the release for consultation of draft legislative proposals to implement tax measures from Budget 2011, the Next Phase of Canada’s Economic Action Plan—A Low-Tax Plan for Jobs and Growth. August 16, 2011
The proposed legislation would also affect retirement plans as follows:
- Introduce anti-avoidance rules for Registered Retirement Savings Plans.
- Introduce rules to limit tax deferral opportunities for individual pension plans by imposing minimum annual withdrawal requirements similar to those for Registered Retirement Income Funds and by reducing the tax advantages related to making contributions to an individual pension plan in respect of past service.

The proposed amendments to the Pension Benefits Standards Regulations, 1985 would:
- Permit plan sponsors to secure properly structured letters of credit in lieu of making solvency payments to the pension fund, up to a limit of 15 per cent of plan assets.
- Require plan sponsors to fully fund pension benefits on plan termination.
- Void any amendments to a pension plan that would reduce the solvency ratio of the pension plan if the plan’s solvency ratio would be below 0.85.
- Permit sponsors, plan members and retirees of a distressed pension plan to negotiate their own funding arrangements to facilitate a plan restructuring.
