O’DWYER & BERNSTIEN is seeking two (2) attorneys to join its union-side labor and employee benefits (ERISA) practice.

O’Dwyer & Bernstien has been representing labor unions and fighting for working class people for over 100 years. We are currently seeking two labor and ERISA/employee benefits attorneys – one for a junior to mid-level attorney with one (1) to four (4) years of labor and employee benefit plan experience and another for an attorney with seven (7) or more years of labor and employee benefit plan experience. Experience in multiemployer Taft-Hartley benefit plans is a plus. Litigation experience and work in front of the NLRB or arbitration is also a plus. The firm is located in New York but both positions offer flexible remote work opportunity, with travel once per month to Washington, DC, possibly more nationally if desired.

On the labor side, responsibilities will include advising and representing international and local unions on everything from organizing new contractors and members to administering the organization’s internal affairs, policies and programs. Candidates with experience practicing before the NLRB and its Regions will have IMMEDIATE opportunities to practice before the board.

On the employee benefits side, the candidate’s work will include assisting benefit plan personnel, trustees and unions with the full range of issues faced by all types of employee benefit plans, including drafting and review of plan documents, service provider contracts and participant communications. You will IMMEDIATELY begin meeting and working directly with clients and attending various client meetings throughout the country.

Experience in handling benefit plan-related litigation, including contribution enforcement, withdrawal liability, post-judgment enforcement, benefit claims and fiduciary breaches is preferred but not required. The successful candidate must be a member of the New York bar. Must have strong writing, speaking and analytical skills, and be a practical thinker with the ability to interact well with clients and plan professionals.
