Mr. Castleton is a Senior Counsel with Proskauer’s Employee Benefits, Executive Compensation & ERISA Litigation Practice Center. His practice focuses on the design, tax qualification, and compliance of defined contribution, defined benefit, nonqualified executive compensation, and health and welfare plans, including experience with multiemployer, multiple employer, prototype, and volume submitter plans. Mr. Castleton counsels plan sponsors and service providers on: plan documentation, including drafting plan documents, SPDs, amendments, and plan administrative procedures; plan qualification, including representing clients before the Internal Revenue Service concerning plan determinations and closing agreements; plan administration, including resolving benefit claims, managing third-party service provider relationships, and correcting plan compliance issues; fiduciary duty compliance; prohibited transaction avoidance; employee benefits aspects of mergers and acquisitions; plan terminations; and litigation strategy. In addition, he has experience conducting benefits related litigation and appeals, and has also represented clients in managing labor relations and litigating employment discrimination matters. Mr. Castleton holds a JD degree from George Mason University Law School and an LL.M. degree from Georgetown University Law Center and is admitted to the bar in the District of Columbia, New York and Virginia.
