The Department of Labor's (DOL) Employee Benefits Security Administration (EBSA) released the final 2020 Mental Health Parity and Addiction Equity Act (MHPAEA) Self-Compliance Tool to help employers comply with the MHPAEA and related requirements under the Employee Retirement Income Security Act of 1974 (ERISA).
The updated tool is intended to help group health plans, plan sponsors, plan administrators, health insurance issuers and other parties determine if a group health plan or a health insurance issuer complies with provisions of both laws relating to mental health and substance-use disorder benefits. The tool was last updated in April 2018.
For the final 2020 MHPAEA Self-Compliance Tool, DOL noted minor modifications and clarifications in response to comments from proposed amendments in four main categories:
- Integration of Recent Guidance;
- Revised Compliance Examples;
- Best Practices for Establishing an Internal Compliance Plan; and
- Warning Signs.
DOL, in coordination with the Department of Health and Human Services and the Department of the Treasury, intends to continue to provide additional MHPAEA implementation guidance on a rolling basis, including updated enforcement data and revised compliance program documents.
