DOL Releases Final Rule Prohibiting Illegal Discrimination in Registered Apprenticeship Programs

Published November 05, 2026

The U.S. Department of Labor (DOL) released a final rule to remove affirmative action requirements that were previously imposed on Registered Apprenticeship program sponsors. The rule also streamlines nondiscrimination requirements, clarifies sponsors’ responsibility to comply with federal and state nondiscrimination laws, and makes conforming technical changes to DOL regulations governing Labor Standards for the Registration of Apprenticeship Programs.

Under the final rule:

  • Sponsors must comply with applicable federal and state nondiscrimination laws rather than a separate set of apprenticeship-specific requirements.
  • Affirmative action requirements are eliminated, including requirements for sponsors with five or more apprentices to conduct utilization analyses and establish numerical hiring goals based on race, sex and ethnicity.
  • Certain equal employment opportunity (EEO) administrative requirements are removed, including mandates to designate an individual to oversee EEO policy, conduct anti-harassment training and post an equal opportunity pledge.
  • The discrimination complaint framework is revised to clarify where apprentices can raise and seek resolution of discrimination-related concerns.
  • State Apprenticeship Agencies must conform their laws and regulations to the revised federal requirements to obtain or maintain recognition from DOL’s Office of Apprenticeship.
The final rule is effective January 5, 2027.
