Staff Litigation Counsel

POSITION TITLE: Staff Litigation Counsel

POSITION DESCRIPTION

SUMMARY:

Work with attorneys and professionals to provide litigation support to the IAM National Pension Fund, the IAM National 401(k) Fund and the National IAM Benefit Fund (collectively the “Funds”). Under the supervision of the General Counsel, this position, will provide litigation counsel and represent the Funds in court or arbitration proceedings.

RESPONSIBILITIES:

  • Under supervision of the General Counsel, handle matters involving withdrawn employers and withdrawal liability cases, including but not limited to arbitrations.
  • Draft, review and finalize the Notice and Demands, payment arrangements, negotiate payment plans, and prepare requests for review of withdrawal liability calculations, and other correspondence with withdrawn employers.
  • Under supervision of the General Counsel, handle matters involving withdrawal liability and delinquency collection cases in court and arbitration proceedings.
  • Work with other relevant Funds Departments on the collection of delinquent contributions.
  • Oversee paralegal preparation of demand letters for collection of delinquent contributions.
  • Direct paralegal to timely prepare, create and provide collection status reports to General Counsel.
  • Perform legal and factual research.
  • Conduct discovery in pending litigation.
  • Draft legal arguments, briefs, affidavits, declarations and motions.
  • Identify relevant judicial decisions, statutes, legal articles, codes and other pertinent material.
  • Organize and analyze information with paralegal support.
  • Cross-check and validate information with paralegal support.
  • Assist General Counsel prepare litigation reports for the Boards of Trustees.
  • 4 to 5 years of litigation experience preferred.
  • Must be a member of the bar of the District of Columbia.

WORK ENVIRONMENT

This job operates in a professional office environment. This role routinely uses standard office equipment such as computers, phones, photocopiers, filing cabinets and fax machines.

EXPECTED WORK HOURS

  • Minimum of 40 hours per week
  • Overtime when necessary
  • Weekend overtime when necessary
